Terms of use.
Agreed before we start.

The terms for using this site, and how we work with you once you ask us to act. The short version comes first.

Two women talking across a table

When we start work

Once you’ve agreed the fee in writing, and not before.

1

partner

Leads your matter, from the first call to the final letter.

A man writing at his kitchen table

These terms cover your use of this website and how we work with you before and after you ask us to act. By using the site, you agree to them. When you instruct us, our costs agreement sets the terms for that matter.

About these terms

They apply to this website and to anything you send us through it.

“We”, “us” and “Avenue” mean Avenue Lawyers, Level 9, 88 Queen Street, Melbourne VIC 3000. When you instruct us on a matter, our costs agreement and letter of engagement apply as well. If they differ from these terms, they take priority.

Information, not advice

What you read here is general. It isn’t advice about your situation.

Our pages and notes explain the law in plain English, but they can’t take account of your facts, and the law changes. Please don’t act, or decide not to act, on anything here without talking to us first.

When we become your lawyers

Once you’ve agreed the fee in writing, and not before.

Reading this site, sending us a message or having a first call with us doesn’t make us your lawyers. We act for you once we’ve checked for conflicts, you’ve received our costs disclosure, and you’ve signed our costs agreement or accepted it in writing.

Fees and estimates

A fixed fee or a capped estimate, agreed before any work starts.

We’ll tell you in writing what the work will cost, what’s included, and any other costs, such as court fees or a barrister. If something changes the estimate, we’ll tell you before we go further. You can ask for an itemised bill at any time, and the Legal Profession Uniform Law gives you rights to dispute our costs.

Who does the work

One partner leads your matter, from the first call to the final letter.

Your partner is responsible for your matter throughout and works on it with the two lawyers in their team. If we need a barrister or another expert, we’ll explain why and agree it with you first.

Writing to us before you instruct us

Give us the outline, not the details, until we’ve checked for conflicts.

Until we confirm we can act for you, please don’t send confidential documents. If we already act for someone on the other side, we may not be able to help you, and we’ll say so without reading further.
